A Complaint or Objection Against the Government

A government organisation makes decisions about, for example, an application, taxes, or a permit. If you do not agree with such a decision, you often have the right to file an objection (bezwaar). The letter you receive from the government will state how you can do this and within what period. You must explain which decision you disagree with and why. Keep copies of the decision, your objection, and proof that you sent it on time. Simply calling for clarification is usually not considered a formal objection. The time limit for objection is usually six weeks from the date the decision is announced, but always read the deadline and instructions in your letter carefully. If, after receiving the official response to your objection, you still do not agree with the government’s decision, in many cases you can appeal (beroep) to a court.
A complaint (klacht) concerns the way an organisation or employee has treated you. For example, perhaps you did not receive a response, or a conversation was not handled carefully. You should first submit your complaint using the organisation’s own procedure, describing what happened, when it occurred, and with whom. If you cannot resolve it this way, in certain cases a municipal ombudsman (gemeentelijke ombudsman) or the National Ombudsman (Nationale ombudsman) can look further into the matter. An objection to a decision and a complaint about conduct each have their own purpose.
Police and civil servants (ambtenaren) must also adhere to rules. If you have a complaint about how the police have treated you, first submit a complaint to the police using the complaints procedure at politie.nl. If you are not satisfied with how your complaint is handled, you can ask the National Ombudsman to review it. You may also report discrimination or corruption. Corruption means, for example, that a civil servant asks for money or a gift in exchange for processing an application more quickly. Never make such a payment. Record clearly what happened in a safe manner and look for an official reporting process or seek independent legal advice. You are never required to make an unusual payment for a standard government service.
A letter from the government can be complicated. Underline the decision, the date, and the section about how to file an objection or complaint. Ask for help if you do not understand the text, but do not wait until the deadline has passed. An advisor can help you list the facts and select the appropriate procedure.

Een klacht of bezwaar bij de overheid
Een overheidsorganisatie neemt besluiten over bijvoorbeeld een aanvraag, belasting of vergunning. Ben je het niet eens met zo’n besluit, dan kun je vaak bezwaar maken. Op de brief staat hoe dat moet en binnen welke termijn. Leg uit met welk besluit je het oneens bent en waarom. Bewaar het besluit, je bezwaar en het bewijs dat je het op tijd hebt verstuurd. Alleen bellen voor uitleg is meestal geen formeel bezwaar. Meestal is de bezwaartermijn zes weken vanaf de bekendmaking van het besluit, maar lees altijd de termijn en instructies in jouw brief. Ben je het na de beslissing op bezwaar nog niet eens met de overheid, dan kun je in veel gevallen in beroep bij de rechter.
Een klacht gaat over de manier waarop een organisatie of medewerker jou heeft behandeld. Misschien kreeg je geen antwoord of verliep een gesprek onzorgvuldig. Dien de klacht eerst in via de route van de organisatie en beschrijf wat er is gebeurd, wanneer en met wie. Kom je er niet uit, dan kan een gemeentelijke ombudsman of de Nationale ombudsman in bepaalde gevallen verder kijken. Bezwaar tegen een besluit en een klacht over gedrag hebben dus elk een eigen doel.
Ook politie en ambtenaren moeten zich aan regels houden. Heb je een klacht over hoe de politie je heeft behandeld? Dien die eerst bij de politie in via de klachtenregeling op politie.nl. Ben je niet tevreden over de afhandeling, dan kun je de Nationale ombudsman vragen om ernaar te kijken. Discriminatie en corruptie mag je melden. Corruptie betekent bijvoorbeeld dat een ambtenaar om geld of een cadeau vraagt om een aanvraag eerder te behandelen. Betaal zoiets niet. Noteer veilig wat er gebeurde en zoek een officiële meldroute of onafhankelijk juridisch advies. Je hoeft geen ongebruikelijke betaling te doen om een normale overheidstaak te laten uitvoeren.
Een brief van de overheid kan ingewikkeld zijn. Onderstreep het besluit, de datum en de passage over bezwaar of klacht. Vraag hulp als je de tekst niet begrijpt, maar wacht niet tot de termijn voorbij is. Een adviseur kan helpen om feiten op een rij te zetten en de passende procedure te kiezen.
