Both tenant and landlord have rights and obligations. The tenant pays the agreed rent and uses the dwelling responsibly. The landlord must provide maintenance according to the applicable rules. Not every repair is the responsibility of the same person: small, everyday tasks are often for the tenant, while larger maintenance is usually for the landlord.

Delayed maintenance means that necessary repairs are not carried out, or are carried out too late. For example, a leak or a broken heating system. Report a problem to the landlord as precisely as possible and do so in writing. Describe when it began, add photographs and keep the response. If there is an immediate danger, follow the appropriate emergency procedure.

A rent increase or the calculation of service charges can also raise questions. An increase is not automatically unjustified. Check the letter, your contract, and the rules that apply to your rental property. Respond within the required period if you disagree with a decision or payment. For service costs, you can request a breakdown of what the landlord has actually spent. This helps you to determine whether the bill matches the agreements.

If you cannot reach agreement with the landlord, seek independent advice. Do this as well if the landlord does not comply with the agreements in the rental contract. The Huurcommissie (Rent Assessment Committee) can handle certain disputes about rent, service charges, and maintenance. The gemeente (municipality) can act against unwanted behaviour by a landlord. The Juridisch Loket (Legal Helpdesk) can help you determine which route is appropriate for your problem. Beforehand, ask which documents you need and who has the final decision.

Huurders hebben rechten

Huurder en verhuurder hebben allebei rechten en plichten. De huurder betaalt de afgesproken huur en gebruikt de woning zorgvuldig. De verhuurder moet zorgen voor onderhoud volgens de geldende regels. Niet elke reparatie is voor dezelfde persoon: kleine dagelijkse klussen zijn vaak voor de huurder, groter onderhoud meestal voor de verhuurder.

Achterstallig onderhoud betekent dat noodzakelijke reparaties niet of te laat worden gedaan. Denk aan een lekkage of een kapotte verwarming. Meld een probleem zo precies mogelijk aan de verhuurder en doe dat schriftelijk. Beschrijf wanneer het begon, voeg foto's toe en bewaar de reactie. Bij direct gevaar volg je de passende spoedroute.

Ook een huurverhoging of de berekening van servicekosten kan vragen oproepen. Een verhoging is niet automatisch onterecht. Controleer de brief, het contract en de regels die voor jouw huurwoning gelden. Reageer binnen de termijn als je het niet eens bent met een besluit of betaling. Bij servicekosten kun je om een overzicht vragen van wat de verhuurder werkelijk heeft uitgegeven. Dat helpt om te begrijpen of de afrekening past bij de afspraken.

Kom je er met de verhuurder niet uit, vraag dan onafhankelijk advies. Doe dat ook als de verhuurder zich niet aan afspraken in het huurcontract houdt. De Huurcommissie kan bepaalde geschillen over huurprijs, servicekosten en onderhoud behandelen. De gemeente kan optreden tegen ongewenst gedrag van een verhuurder. Het Juridisch Loket kan helpen bepalen welke route bij jouw probleem past. Vraag vooraf welke documenten nodig zijn en wie uiteindelijk een beslissing kan nemen.
